Just because you might owe a debt does not mean the folks suing you have the right to bring the lawsuit. If it’s not the original credit card company then that means the debt has been sold to a debt collector.

There are rules to these sales. These rules exist for good reason, too. Not all credit card lawsuits are brought by the right people.

What prevents a company from selling a debt more than once?

The laws requiring debt sales to be in writing and to clearly identify the debt being sold prevent double sales. Many debt sales don’t meet these requirements.

This means that settling with a company that doesn’t have their paperwork in order leaves you vulnerable to another lawsuit from another company claiming to own the debt.

What about really old credit card debts?

Credit cards debts have a six-year statute of limitation. Whether your debt is older than six years depends on the facts of your individual case.

A debt collector does not have a right to collect a debt beyond the statute of limitations. In other words, credit card lawsuits on accounts you stopped paying on, and stopped charging on, more than six years ago cannot, and should not, be brought.
